We at Nauticallventures, Inc. would like to thank you for your interest in our products. A. Nauticallventures, Inc. makes the following Guarantee to the original consumer purchaser of Versifloat™:

1. Guarantees the seams of the Versifloat™ Inflatable Pontoon for a period of two (2) years from the date of original purchase against separation and subsequent loss of air.

2. Guarantees the fabric used in the construction of the Inflatable Pontoon against defects in workmanship and materials for a period of two (2) years from the date of original purchase.

3. Handles and all other Versifloat™ attachments or Versifloat™ accessories attached to or purchased for attachment to or use on the Versifloat ™ are warranted for a period of one (1) year from the date of original purchase against defects in workmanship and material.

4. Deckboards are warranted for a period of one (1) year from the date of original purchase against defects in workmanship and material. Non-skid coating is not a covered option under the Versifloat™ warranty.

Nauticallventures, Inc. further warrants all parts used on Nauticallventures, Inc. built docks and accessories purchased new by original owner, to be free from defects in the material and workmanship under normal use for a period of 90 days from the date of purchase.

If, within the Guarantee periods set forth above, your new Versifloat™ is proved to Nauticallventures, Inc. satisfaction to be defective, non-conforming parts will be repaired without charges for parts or labor, or replaced at Nauticallventures, Inc.’s option.

Other Limitations or Exclusions

1. This Guarantee coverage is extended only to the original purchaser, and this Guarantee may not be transferred or assigned.

2. This Guarantee shall not apply to Versifloat™ (s) subjected to negligence, accident, improper operation or transporting, improper maintenance or storage, or other than normal use or application, as described in the Versifloat™ Product Specifications Guide or to damage by circumstances beyond Nauticallventures, Inc.’s control.

3. This Guarantee does not cover damage to the Versifloat™ Inflatable Pontoon because of puncture, tearing, ripping, abrasion, ordinary wear and tear, abuse, negligence or modification to the pontoon or over inflation.
WARRANTY IS VOID IF DAMAGE IS DUE TO OVERINFLATION BY USE OF AN AIR COMPRESSOR.

4. PVC pontoons are not to be stored in direct sunlight or under heat absorbing cover.

5. No other express warranty or guarantee, except as mentioned above, given by any person or entity with respect to Nauticallventures, Inc. products shall bind Nauticallventures, Inc. This warranty superseded all other warranties expressed or implied.

NO IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE APPLY TO NAUTICALLVENTURES, INC. PRODUCTS AND ARE HEREBY DISCLAIMED.

B. The customer’s remedies with respect to defective Nauticallventures, Inc. products shall be exclusively limited to the repair or replacement remedy as provided herein and in no event shall Nauticallventures, Inc. be liable for loss of profits, revenues, savings, inconvenience, associated costs, expense for equipment or service, use of capital, facilities, services, storage charges, damage to property, or any other special, incidental or consequential damages caused by the use or misuse of, or inability to use the Nauticallventures, Inc. product, regardless of the legal theory on which the claim is based, and even if Nauticallventures, Inc. has been advised of such damages. In no event shall recovery of any kind against Nauticallventures, Inc. be greater in amount than the purchase price of the Nauticallventures, Inc. product sold. Without limiting the foregoing, the purchaser assumes all risk and liability for loss, damage or injury to persons, animals or property arising out of use or misuse of, or inability to use, the Nauticallventures, Inc. product. Nauticallventures, Inc. is not liable for third party claims.

NAUTICALLVENTURES, INC. SHALL NOT IN ANY EVENT BE LIABLE FOR DEATH, INJURIES TO PERSONS OR PROPERTY OR FOR INCIDENTAL, CONTINGENT, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM MISUSE OF OUR FLOATS.

Guarantee Claims Procedure
All Guarantee claims must be made within thirty (30) days after discovery of defect and submitted on the Versifloat™ Guarantee claim form available from the dealer together with proof of purchase. Photographs illustrating damage, if any, should accompany the claim. An authorized representative may make an inspection, within a reasonable time, after receipt of the claim.

When a Guarantee claim is valid Nauticallventures, Inc. will repair, have repaired, or at its option, replace the Versifloat™ or defective part free of charge. Freight and transportation charges, where applicable, incurred in shipping a Versifloat™ to be repaired or replaced are to be paid by consumer purchaser.

Other Important Information

1. Nauticallventures, Inc. reserves the right to make changes in the design and material of its Versifloat™ without incurring any obligations to incorporate such changes in units already complete or in the hands of the dealers or consumers.

2. The entire obligation of Nauticallventures, Inc. regarding the sale of Versifloat™ is stated within this written Guarantee. Nauticallventures, Inc. does not authorize its dealers or any other person to assume for it any other liability in connection with the sale of its Versifloat™.

3. Unless otherwise noted this warranty agreement is the only warranty agreement between the parties. This agreement states the limits and association risk between the two parties. Customer acknowledges understanding of this warranty and agreement binding to the terms contained within.

4. OTHER MANUFACTURER’S WARRANTIES

Non Nauticallventures, Inc. manufactured products are sold “as is” without warranty of any kind by Nauticallventures, Inc. including any implied warranty regarding the MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, and all such warranties are disclaimed. The sole warranty, if any, with respect to such non Nauticallventures, Inc. manufactured products is given by the manufacturer or producer thereof. Based upon Nauticallventures, Inc.’s knowledge other warranties are provided directly by other parts manufacturers.

5. The Guarantee herein before set forth is made to you by the manufacturer, Nauticallventures, Inc. If for any reason you are unable to locate a Versifloat™ dealer or if the dealer does not provide satisfactory Guarantee service,
